LEGAL INFORMATION AND CONDITIONS OF USE 1. DESCRIPTION OF THE SITE
The web site operating under the domain name http://www.miguelservet.org (hereinafter,
the Through the Web Site, the INSTITUTE makes material freely available to the User materials which include messages, graphics, pictures, sound and image files, photographs and, in general, company information relating to the activities and purposes and mission of the INSTITUTE (hereinafter, the "Materials"), in accordance with the terms and conditions described in the following section. 2. CONDITIONS FOR ACCESS AND USE OF THE WEB SITE Access to the Web Site and Materials, as well its use, is subject to these conditions of use (hereinafter, the "Conditions of Use"). If the User does not agree with the Conditions of Use, the User should not use the Web Site at all, and, in particular, it should not download or use the Materials in any other way. The use of the Web Site is also subject to any warnings, rules of use or instructions that the INSTITUTE makes known to the Users, which shall complement those set forth in these Conditions of Use should they be accepted. 3. EXCLUSION OF OBLIGATIONS TO PROVIDE PRIOR AND SUBSEQUENT INFORMATION The User accepts that the only information relating to the process of accepting the present Conditions of Use that it will receive before being bound by them is the information that has been provided with up until now and the information contained or referred to herein. After its acceptance by the User, the INSTITUTE will not be obligated to send the User any other type of confirmation or acknowledgement of receipt. If the User is not a consumer, the User specifically agrees to reject the application of any other legal provisions that impose obligations to provide prior information and/or subsequent confirmation of the acknowledgment of receipt in relation to the acceptance process set forth in these Conditions of Use, and in particular, the User shall reject the application of articles 27 and 28 of Law 34/2002 of 11 July on information society services and e-commerce. 4. MODIFICATION OF THE WEB SITE AND THE CONDITIONS OF USE The INSTITUTE reserves the right to unilaterally, and without warning, change the presentation and configuration of the Web Site, as well as modify or remove any of the Materials. In addition, the INSTITUTE may modify the conditions that must be met in order to access and use the Web Site. When using the Web Site, the User shall express his acceptance of the version of Conditions of Use that is published at the time of acccessing the Web Site. For this reason, every time the User uses the Web Site he must carefully read the Conditions of Use beforehand. If the User does not agree with the modified Conditions of Use, the User must not use the Web Site in any way, and in particular, the User must not download or use the Materials in any other way. 5. OBLIGATION TO MAKE CORRECT USE OF THE WEB SITE The authorised User must use the Web Site in accordance with the applicable law and Conditions of Use, in a correct and diligent manner, and must abstain from using it with aims or effects that are illegal, harmful to the rights and interests of third parties, or which in any way cause damage, render useless, overload or deteriorate the Web Site, or prevent the ordinary use of the Web Site by other users. 6. USE OF THE MATERIALS The Web Site has various Materials (as defined in Section 1 of this document). Unless the Web Site indicates to the contrary with respect to any Materials in particular, the INSTITUTE authorizes the User to download any Material for his private use in accordance with the authorized uses of the Web Site. The use of the Materials for academic purposes shall be considered private use, even if this activity entails the distribution of the Materials among two or more people. The User shall indicate the source of the Materials. The authorization granted in this paragraph may be revoked by the INSTITUTE at any time by means of a warning on the Web Site. 7. USE OF COOKIE TECHNOLOGY Some of the pages of the Web Site may use cookies in order to provide materials to the User that are adjusted to its preferences. Usually, the User can configure the internet browser to warn it of the receipt of cookies, giving the User the opportunity to decide whether it wishes to accept them or not. Technically, the acceptance of cookies coming from the Web Site would be necessary to gain access to the Materials. 8. LIABILITY FOR DAMAGES The User shall be liable for any damages of any nature that the INSTITUTE or a third party may suffer, directly or indirectly, as a consequence of a breach of the obligations derived from the Conditions of Use, the law, or the rights of the INSTITUTE or of third parties that make use of the Web Site. These obligations will remain in force even after the termination of the User's relationship with the INSTITUTE or his use of the Web Site. The User undertakes to defend, indemnify, and hold the INSTITUTE and/or their suppliers harmless from any claims or actions of any type, as well from as any expenses or costs (including, among others, lawyers fees), that arise or derive from a breach on the part of the User of the Conditions of Use, applicable legal provisions or the rights of third parties. These obligations will remain in force even after the termination of the User's relationship with the INSTITUTE or his use of the Web Site.
